Opdycke v. Hammett & Hammett

John Hammett and Johnson Hammett gave Opdycke a promissory note but paid only a portion of the note. Opdycke requested another promissory note for the balance of $62. Hammett and Hammett failed to pay, and Opdycke sued them in JP court. Hammett and Hammett argued that the note was usurious. The jury agreed and found for Hammett and Hammett. Opdycke appealed to the Tazewell County Circuit Court, which issued a writ of certiorari. Lincoln wrote the power of attorney appointment for Opdycke. Hammett and Hammett motioned to dismiss the certiorari, and the court agreed and affirmed the decision of the JP.
